From Offender- Centered Justice Going to Victim- Centered Justice : Reconstructing the Post- Verdict Victim Protection Model in System Justice Indonesian Criminal Code

Abstract

System justice criminal law in Indonesia is still offender - centered , so that post- victim protection decision not optimal. Although regulation legislation ensure victim's rights to restitution , compensation , rehabilitation , and protection , their implementation Still weak consequence No effectiveness enforcement restitution , limited coordination inter-agency , as well as absence mechanism monitoring recovery . Research law normative This use approach regulation legislation , conceptual , comparative , and case with analysis systematic-comparative . Research results show that victim protection ends at the verdict powerful law still without ensure fulfillment victims' rights . Research This proposes the Post-Judgment Victim Recovery System (PJVRS) as an integrated model that integrates enforcement restitution , rehabilitation , coordination inter-agency , monitoring post decisions and assessments victim recovery .
